General Sales Conditions
Art. 1 – General provisions
By browsing this area, the user accesses Braschi – Ecommerce, available via the URL: https://www.braschistore.com (hereinafter referred to as “Braschi”). Navigation and the transmission of a purchase order on the site implies acceptance of the Conditions and Data Protection Policies adopted by the site mentioned herein.
These General Sales Conditions apply to the sale of products with exclusive reference to purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree no. 206/05 amended by Legislative Decree no. 21/14 and Legislative Decree 70/03) by Societa Royal Trade S.p.A. Address: Strada dei Censiti, 1 – 47891 – Falciano (RSM) C.o.e. SM 06571.
The user is required, before accessing the products provided by the site, to read these General Sales Conditions, which are generally and unequivocally accepted at the time of purchase.
Users are encouraged to download and print a copy of the purchase form and these General Sales Conditions, whose terms Braschi reserves the right to unilaterally change without any notice.
Art. 2 – Object
These General Sales Conditions govern the offering, forwarding, and acceptance of purchase orders of products on Braschi and do not regulate, however, the provision of services or the sale of products by parties other than the seller present on the same site through links, banners, or other hyperlinks. Before placing orders and purchasing products and services from different parties, we suggest checking their sales conditions.
To conclude the purchase contract, it will be necessary to fill in the form electronically and send it following the related instructions.
It contains the reference to the General Sales Conditions, images of each product and its respective price, the payment methods that can be used, delivery methods of the products purchased, and their shipping and delivery costs; a reference to the conditions for exercising the right of withdrawal; methods and times for returning purchased products.
Before concluding the contract, you will be asked to confirm that you have read the General Sales Conditions, including information on the right of withdrawal and the processing of personal data.
The contract is concluded when the seller receives the form filled out by the user, after verifying the accuracy of the data contained therein.
The user will be obligated to pay the price from the moment the online order forwarding procedure is concluded. This will be done by clicking on the “Buy” button at the end of the guided procedure.
Once the contract is concluded, the seller takes charge of the order for its fulfillment.
Art. 4 – Registered users
In completing the registration procedures, the user undertakes to follow the instructions on the site and provide their personal data correctly and truthfully.
Confirmation will, in any case, release Braschi from any responsibility regarding the data provided by the user. The user undertakes to promptly inform Braschi of any changes to their data communicated at any time.
If the user provides inaccurate or incomplete data or if there is a dispute by the interested parties regarding payments made, Braschi will have the right to not activate or suspend the service until the deficiencies are rectified.
Upon the user’s first request to activate a profile, Braschi will assign a username and password. The latter acknowledges that these identifiers constitute the system for validating the user’s access to the Services and the only suitable system to identify the user; acts performed through such access will be attributed to him and will be binding on him.
The user undertakes to keep his access data confidential and to keep them with due care and diligence and not to transfer them, even temporarily, to third parties.
Art. 5 – Product availability
Product availability refers to the actual availability at the time the user places the order. This availability must, however, be considered purely indicative because, due to the simultaneous presence on the site of multiple users, the products could be sold to other customers before confirming the order.
Even after sending the order confirmation email, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically adjusted with the elimination of the unavailable product, and the user will be immediately informed via email.
If the user requests the cancellation of the order, terminating the contract, Braschi will refund the amount paid within 30 days from the moment Braschi became aware of the buyer’s decision to terminate the contract.

Art. 7 – Payment Methods and Prices
The price of the products will be as indicated on the website, except where there is a clear error. 2. In case of error, Braschi will notify the buyer as soon as possible, allowing for confirmation of the order at the correct amount or cancellation. In any case, Braschi is not obliged to supply what was sold at the mistakenly lower price. 3. The website prices include VAT and include shipping costs. Prices can change at any time. Changes do not affect orders for which an order confirmation has already been sent. 4. Once the desired products have been selected, they will be added to the cart. Just follow the purchase instructions, entering or verifying the information requested at each step of the process. Order details can be changed before payment. 5. Payment can be made through: PayPal and Credit cards accepted by PayPal.
Art. 8 – Delivery
Braschi ships throughout Italy, excluding the Vatican City state and the Republic of San Marino. 2. Braschi will only deliver to the user’s home address provided at the time of purchase. 3. Delivery is generally made within 4-6 days, or if no delivery date is specified, within the estimated time when selecting the delivery method and, in any case, within a maximum of thirty days from the confirmation date. 4. If delivery is not possible, the order will be sent to a depot. In this case, a notice will specify the location of the order and how to arrange a new delivery. 5. If you are unable to be at the delivery location at the agreed time, we ask you to contact us again to arrange a new delivery date. 6. If delivery cannot take place for reasons not attributable to us after thirty days from the date the order is available for delivery, we will assume that you intend to terminate the contract. 7. As a result of termination, amounts will be refunded, including delivery costs, excluding any additional costs resulting from choosing a delivery method other than the standard method offered, without undue delay and, in any case, within 29 days from the contract termination date. The transport resulting from contract termination may incur additional costs borne by the buyer. 8. Shipping costs are borne by the buyer and are explicitly highlighted when placing the order.
Art. 11 – Withdrawal
In accordance with current legal provisions, the buyer has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days under art. 57 of Legislative Decree 206/2005 from the date of receipt of the products. 2. In the case of multiple purchases made by the buyer with a single order and delivered separately, the 30-day period starts from the date of receipt of the last product. 3. The user intending to exercise the right of withdrawal must communicate this to Braschi with an explicit statement, which can be sent by registered mail with return receipt to the address: Strada dei Censiti, 1 – 47891 – Falciano (RSM) 4. The buyer can also exercise the right of withdrawal by sending any explicit statement containing the decision to withdraw from the contract or alternatively send the standard withdrawal form, as per Annex I, part B, Legislative Decree 21/2014, which is not mandatory. 5. The goods can be returned to any point of sale in Italy, as indicated on our website, or sent to: Strada dei Censiti, 1 – 47891 – Falciano (RSM) 6. The goods must be returned intact, in the original packaging, complete in all its parts, and with the attached tax documentation. Subject to verifying compliance with the above, the site will refund the amount of the products subject to withdrawal within a maximum period of 10 days, excluding any shipping costs incurred by the user. 7. The return costs will be borne by Braschi. 8. As provided by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, the site may suspend the refund until the receipt of the goods or until the buyer has demonstrated that they have returned the goods. 9. The right of withdrawal will not apply in cases where Braschi’s services and products are included in the categories of art. 59 of Legislative Decree 206/2005. 10. The site will make the refund using the same payment method chosen by the buyer during purchase. In case of payment made by bank transfer, and if the user intends to exercise their right of withdrawal, they must provide the bank details: IBAN, SWIFT, and BIC necessary for making the refund.
Art. 8 – Transfer of Risk
The risks related to the products will be borne by the buyer from the moment of delivery. The ownership of the products is considered acquired once full payment of all amounts due in relation to them has been received, including shipping costs, or at the time of delivery if it takes place later.
Art. 9 – Warranty and Commercial Conformity
The seller is responsible for any defect in the products offered on the site, including the non-conformity of the items to the ordered products, in accordance with Italian regulations. If the buyer has entered into the contract as a consumer, i.e., any individual who acts on the site for purposes unrelated to any entrepreneurial or professional activity possibly carried out, this warranty is valid provided that the defect appears within 24 months from the product delivery date; that the buyer makes a formal complaint about the defects within a maximum of 2 months from the date the defect was recognized by them; that the online return form is correctly filled out. In the event of non-conformity, the buyer who entered into the contract as a consumer will have the right to restore the conformity of the products at no cost, through repair or replacement, or to obtain an appropriate price reduction or the termination of the contract concerning the goods and products. Disputed products and the subsequent price refund. All return costs for defective products will be borne by the seller.

In the event that one of the clauses of these General Sales Conditions should be null and void for any reason, this will in no way compromise the validity and compliance of the other provisions set out in these General Sales Conditions.

Art. 15 – Applicable Law and Jurisdiction
These General Sales Conditions are governed by Italian law and are interpreted according to it, without prejudice to any different overriding provision of the country of habitual residence of the buyer. As a result, the interpretation, execution, and resolution of the General Sales Conditions are subject exclusively to Italian law. 2. Any disputes relating to and/or resulting from them must be resolved exclusively by the Italian judicial authority. Specifically, if the user qualifies as a Consumer, any disputes must be resolved by the court of the place of domicile or residence of the same according to the applicable law.
